Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Naif AlQazlan ("we," "us," or "our"), the developer of Zinq ("App"). By downloading, installing, or using the Zinq app on any device, you agree to be bound by these Terms.

If you do not agree to these Terms, do not install or use Zinq.

These Terms apply in addition to any terms imposed by the Apple App Store or Google Play Store, which also govern your relationship with those platforms.

Zinq is rated for ages 4+ (iOS) and Everyone (Android). Anyone of any age may use the App.

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are a parent or guardian and you have allowed your child to use the App, you agree to these Terms on behalf of your child and are responsible for your child's use of the App.

Zinq does not require account creation and collects no personal information from users of any age beyond what is described in our Privacy Policy.

Zinq is a mobile trivia game that lets you answer questions, track your score and streak, and share challenge links with friends. The App is available on iOS and Android.

No Account Required

Zinq does not require you to register an account, provide an email address, or link any social profile. A random device identifier is generated automatically on first launch to power core gameplay features.

Availability

We provide the App on an "as-is" basis. We do not guarantee that the App will be available at all times or without interruption. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

Updates

We may release updates to the App through the App Store or Google Play. Some updates may be required for continued use. By enabling automatic updates on your device, you agree that the App may update automatically.

In-App Purchases

Zinq may offer optional in-app purchases in the future. Any such purchases will be clearly labeled, priced, and processed through Apple's or Google's respective payment systems. We will update these Terms before introducing any paid features.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install one copy of the App on a device you own or control.
• Use the App for your personal, non-commercial entertainment purposes.

This license does not include the right to:

• Copy, modify, distribute, or create derivative works based on the App or its content.
• Sell, resell, sublicense, rent, or lease access to the App.
• Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
• Remove or alter any copyright, trademark, or other proprietary notices in the App.
• Use the App for any commercial purpose without our express written consent.

Display Name

You choose your own display name and emoji avatar. You are free to use any name — real or fictitious. You are solely responsible for the display name you choose. You may not use a display name that:

• Impersonates another person or entity.
• Is offensive, vulgar, or hateful.
• Infringes any trademark or intellectual property right.

Share Links

When you share a challenge link, you are sharing a URL that contains a question ID, your device ID, and your answer to that question. You are responsible for the content you choose to share and the platforms on which you share it. Zinq share links should only be sent to individuals who would welcome receiving them.

Ownership of Your Data

Your game data (scores, streaks, question history) belongs to you. We do not claim ownership over it. See our Privacy Policy for full details on how your data is stored and how to delete it.

You agree not to use Zinq in any manner that:

• Violates any applicable local, state, national, or international law or regulation.
• Attempts to gain unauthorized access to any part of the App or its underlying systems.
• Interferes with or disrupts the integrity or performance of the App.
• Uses bots, scripts, or other automated means to interact with the App, including generating or submitting answers.
• Attempts to manipulate leaderboards, scores, streaks, or any other game mechanic.
• Extracts or harvests questions, answers, or any App content through automated means (scraping).
• Uses the App to harass, bully, or harm other individuals.
• Attempts to probe, scan, or test the App for vulnerabilities without our written permission.
• Circumvents, disables, or otherwise interferes with security-related features of the App.

Zinq and all of its content — including but not limited to the app name, the lightning bolt logo, trivia questions, answer options, category names, UI design, illustrations, animations, and sounds — are the exclusive property of Naif AlQazlan and are protected by copyright, trademark, and other intellectual property laws.

The "Zinq" name and the ⚡ lightning bolt logo are trademarks of Naif AlQazlan. You may not use them without our prior written permission.

Question Content

All trivia questions and answer options in the App are original content created by or licensed to us. You may not reproduce, copy, publish, or distribute them without our written consent.

Feedback

If you provide us with suggestions, ideas, or feedback about the App ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and incorporate that Feedback into the App or any other product without obligation or compensation to you.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free.
• Any trivia questions or answers in the App are accurate, complete, or up to date. Trivia content is for entertainment purposes — always verify important factual information through authoritative sources.
• The App will meet your specific requirements or expectations.
• Defects in the App will be corrected.

Your use of the App is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

To the maximum extent permitted by applicable law, in no event shall Naif AlQazlan be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

• Loss of data or game progress.
• Loss of profits or revenue.
• Personal injury or property damage.
• Unauthorized access to or alteration of your data.
• Any matter arising from or related to your use of, or inability to use, the App.

In jurisdictions where limitation of liability for consequential or incidental damages is not permitted, our liability is limited to the maximum extent permitted by law.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the App shall not exceed $10 USD or the amount you paid for the App in the 12 months preceding the claim, whichever is greater.

You agree to indemnify, defend, and hold harmless Naif AlQazlan from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App in violation of these Terms.
• Any display name or content you choose that violates the rights of a third party.
• Your violation of any applicable law or regulation.
• Any share links you distribute in violation of these Terms or applicable anti-spam laws.

Termination by You

You may stop using Zinq at any time. Simply delete the App from your device. Upon deletion, your license to use the App terminates automatically.

Termination by Us

We reserve the right to terminate or suspend your license to use the App at any time, with or without notice, if we reasonably believe you have violated these Terms — particularly the Acceptable Use provisions in Section 6.

Because Zinq requires no account, a "termination" by us means that we may block access to App services (e.g., future question content updates or sync endpoints) associated with a particular device ID.

Effect of Termination

Upon termination of your license, you must stop using the App. Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) survive termination.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal legal action, you agree to first contact us at support@zinq.fyi and attempt to resolve the dispute informally. We will make good-faith efforts to resolve the issue within 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

EU/EEA and UK Users

If you are located in the EU, EEA, or UK, mandatory consumer protection laws in your country of residence may apply and cannot be waived by contract. Nothing in these Terms limits your rights under those laws.

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Display an in-app notice the next time you open Zinq.
• For significant changes, provide at least 14 days' notice before the new Terms take effect.

Your continued use of Zinq after the effective date of updated Terms constitutes acceptance of the new Terms. If you do not agree to any changes, you should stop using the App.
